By creating an account, accessing, or using the Service, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them and our Privacy Policy.

2. Description of Service

Clumey provides an AI-powered platform for creating interactive product demos, guided onboarding flows, and self-updating documentation. Features include AI script writing, voiceover generation, localization, interactive hotspots, and engagement analytics (the “Service”).

3. Account Registration

To access most features, you must create an account. You agree to:

Provide accurate, current, and complete registration information.
Maintain the security of your password and accept responsibility for all activity under your account.
Notify us immediately at hello@clumey.com if you suspect unauthorized access.
Not share your account credentials with third parties.

4. Acceptable Use

All rights, title, and interest in the Service, including all software, design, trademarks, and content created by Clumey, Inc., remain exclusively with Clumey, Inc.. These Terms do not grant you any rights to use our trademarks, logos, or brand features without our prior written consent.

You retain ownership of all content you upload or create using the Service (“User Content”). By uploading User Content, you grantClumey, Inc. a worldwide, non-exclusive, royalty-free license to host, process, and display that content solely to provide the Service to you.

6. Payment and Billing

Certain features require a paid subscription. By subscribing you agree to:

Pay all applicable fees as described on our Pricing page.
Provide accurate billing information and keep it updated.
Authorize us (or our payment processor) to charge your payment method on a recurring basis.

All fees are exclusive of taxes. We reserve the right to change pricing with 30 days’ notice. Refunds are issued at our discretion unless required by applicable law.

7. Free Plan and Trials

We may offer a free plan or trial period. We reserve the right to modify or discontinue these offers at any time. At the end of a trial, your account may be downgraded or your access restricted unless you subscribe to a paid plan.

The Service may integrate with third-party services (e.g., CRMs, analytics, storage). Your use of those services is governed by their respective terms. We are not responsible for the content, privacy practices, or availability of any third-party service.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLUMEY, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Clumey, Inc. and its affiliates from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including Sections 5, 10, 11, 12, and 15.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes will be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

16. Miscellaneous

These Terms constitute the entire agreement between you and Clumey, Inc.regarding the Service. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later.
